SCOPE

ORDER AND CONCLUSION OF CONTRACT

You place an order in our online shop. Once you have agreed to the terms and conditions and pressed the BUY button, the order is binding. A legally valid purchase contract is created. Once we receive your order, we will send you an order confirmation email.

OUR DELIVERY AND SALES TERMS

After the order confirmation, we will send you the ordered items to the delivery address you provided. The usual delivery time is 2 – 5 working days.
For orders from abroad, the delivery time may be extended by up to 10 working days.
If the delivery of the goods fails despite repeated delivery attempts, we can withdraw from the contract.

OFFER

Our online offer is subject to change and non-binding. As a rule, the items offered in the online shop are available. If it is not possible to deliver one or more items due to an inventory discrepancy, we will inform you of this fact as quickly as possible. Amounts paid will be refunded as quickly as possible. Order quantities must correspond to normal household quantities.

Prices

Our prices quoted are gross ex warehouse and are stated in Swiss francs including VAT and shipping costs. 

DELIVERY AND SHIPPING

For deliveries within Switzerland and the Principality of Liechtenstein, shipping (B-Post) is free. We charge CHF 7.00 for A-Post.

PAYMENT OPTIONS

For orders within Switzerland and the Principality of Liechtenstein, the payment methods available are advance payment, invoice, credit card and PayPal. Orders from abroad can only be paid via advance payment, credit card or PayPal.

Purchase on account with partial payment option (POWERPAY)

MF Group / POWERPAY, as an external payment service provider, offers the payment method “purchase on account”. With the individual invoice you can easily pay for your online purchase by invoice. If you decide not to pay within the specified time frame, you will subsequently receive a monthly invoice with an order overview in the following month.

Upon conclusion of the purchase contract, POWERPAY assumes the resulting invoice claim and handles the corresponding payment modalities. When purchasing on account, you accept, in addition to our terms and conditions, the terms and conditions of POWERPAY. (powerpay.ch/de/agb).

PREPAYMENT

If you order in advance, the invoice will be sent to you by email. The invoice is due within 30 days. You can easily pay the bill without cash within this period by post or bank transfer. After receipt of payment, we will send you your order immediately.

INVOICE

If you order on account, the invoice will be sent to you by email. The invoice is due within 30 days of the goods being dispatched. You can easily pay the bill without cash within this period by post or bank transfer.

CREDIT CARD

You can also pay for your order by credit card (VISA, Mastercard) or PayPal via the secure payment system Wallee.

LATE PAYMENT

In the event of late payment, we are entitled to charge you a fee of CHF 9.00 from the second reminder. Reminders and invoices are sent by email. In the event of late payment, we are also entitled to assign the debtor's claim and costs to third parties. The right to claim further damages remains reserved.

COUPON

Gift vouchers are vouchers that you can purchase. You can pay for your order with a voucher from Noser Fashion. To do this, enter the code on the voucher in the corresponding field of the order. A gift voucher can only be redeemed before completing the ordering process and for the full amount.

The amount of the voucher is predetermined. The vouchers are issued exclusively in CHF and are freely transferable.

A cash payment is excluded.

PROMOTIONAL VOUCHERS

Promotional vouchers (vouchers that you cannot purchase but that we issue as part of advertising campaigns with a specific period of validity) are only valid for our shop, only valid for the specified period and can only be redeemed once as part of an ordering process.

Promotional vouchers can be redeemed with a minimum order value of CHF 50.00; In any case, the value of the goods must at least correspond to the amount of the promotional voucher. Any difference to a higher value of the goods must be offset using the payment options offered. Promotional vouchers are neither paid out in cash nor bear interest.

A refund of promotional vouchers is excluded if part or all of the ordered products are returned. Promotional vouchers can only be redeemed before completing the ordering process. Subsequent crediting is not possible. The promotional voucher is not transferable and may not be combined with other promotional vouchers. If you have used a promotional voucher for your purchase, we reserve the right to charge you the original price of the goods you are keeping if - due to your cancellation - the total value of the order falls below the value of the promotional voucher.

RESERVATION OF TITLE

The goods remain the property of Noser Fashion until the purchase price has been paid in full.

RIGHT OF WITHDRAWAL/RIGHT OF RETURN

You can cancel the contract within 10 days of receipt of the goods with a description of the reason for the return by returning the goods. The goods are returned at your responsibility and expense.

Only items that are absolutely intact and in perfect, unworn condition will be taken back. In particular, worn, soiled, damaged or bad-smelling products cannot be returned. If this is not the case, we reserve the right to make claims for compensation.

You can deduct the amount of a returned item from the total amount. If the total amount has already been transferred to us, you can choose between a voucher or a refund. Shipping costs are not covered.

DELIVERY DEFECTS

We ask you to immediately check the delivered items for accuracy, completeness and integrity. Complaints regarding scope of delivery, material defects, incorrect deliveries and quantity deviations must be reported to us in writing within 5 working days of receipt of the goods. We will check any defects immediately. If the defects are accepted, you will receive an identical replacement item, if in stock, and the shipping costs will be refunded. Otherwise, the entire amount will be refunded.WARRANTIES
The statutory provisions apply to the warranty in the event of defects.

DATA PROTECTION

The protection of your personal data is very important to us. We observe the applicable data protection regulations and secure your data against unauthorized access by third parties (data security precautions).

Our online shop is encrypted using SSL (Secure Socket Layer), which means that all offer data as well as your payment and customer details are securely transmitted to us.

We may use your personal information to send you special offers or information about new collections. You can revoke your consent to the use of your personal data for advertising purposes at any time by sending an email to info@noser-fashion.com.

We secure our website and other systems through technical and organizational measures against loss, destruction, access, alteration or distribution of your data by unauthorized persons. Access to your shopping account is only possible after entering your personal password.

This website contains social media buttons. By activating the buttons you come into direct contact with the corresponding social network. They may use personal data of its users in a manner that does not comply with data protection regulations because insufficient information is provided about the use of the data. Noser Fashion is not liable for any damage caused by misuse of your personal data by social networks.

APPLICABLE LAW AND JURISDICTION

The place of fulfillment for the seller’s delivery is the respective shipping location. The place of fulfillment for all other obligations is Vaduz/FL. The place of jurisdiction for all legal disputes arising from the business relationships is Vaduz/FL.
The contract concluded between the contracting parties remains binding even if individual provisions or individual paragraphs of these terms and conditions are legally ineffective. An invalid provision and an ineffective business condition must be replaced in good faith by a regulation that comes closest to the purpose of the invalid provision or condition and ensures that the economic purpose of the contract is achieved.
